Texas Judge Denies Karmelo Anthony New Trial Request

A Texas judge rejected Karmelo Anthony’s plea for a new trial, citing courtroom restrictions, absence during hearings, and issues with an unwritten agreement as reasons. Retired District Judge Michael Chitty reviewed evidence before denying the request, keeping Anthony’s murder conviction and 35-year sentence intact. The challenge proceeds on direct appeal.

Collin County District Attorney Greg Willis expressed confidence in the verdict and respect for the court’s decision. He emphasized defendants’ rights to appeal and extended thoughts to the Metcalf family.

A hearing took place after Judge Sid Harle removed Judge John Roach from proceedings due to potential impartiality concerns. A crucial point was an oral agreement between Anthony’s original defense and prosecutors regarding character evidence.

Former defense attorney Mike Howard testified about an agreement believed to allow Anthony to testify on events under a Frisco track meet tent. However, prosecutors later stated it wouldn’t apply, deterring Anthony from testifying. Similar accounts came from attorney Toby Shook.

Lead prosecutor Bill Wirskye disputed claims, noting no clear agreement on testifying defendant coverage. Concerns related to character evidence arose for Anthony, leaving uncertainty on benefits of testifying.

Chitty explored claims of courtroom access restrictions impacting Anthony’s Sixth Amendment rights and jury instructions limiting self-defense considerations.

Anthony, now 19, was convicted in June for killing 17-year-old Austin Metcalf. The jury sentenced him to 35 years in prison. Greg Wehner reports on U.S. news and crime for Fox News Digital, with a focus on law enforcement and public safety.
