David E. Risley Appointed as Acting Legislative Inspector General

David E. Risley, a former federal prosecutor, has been selected to temporarily serve as the Illinois General Assembly’s top ethics watchdog. This decision comes in the wake of controversy surrounding how sexual harassment complaints against former state lawmaker, Harry Benton, were managed. Risley will commence his role as acting legislative inspector general on October 1, following the retirement of Michael P. McCuskey on September 30.

State Rep. Jeff Keicher, chair of the state’s Legislative Ethics Commission, emphasized Risley’s qualifications. “Risley brings over 30 years of expertise in investigations and prosecutorial work,” Keicher stated. Risley has served in various capacities, including as an assistant U.S. attorney in Illinois, an investigator in Iraq, and ethics officer for the Illinois Department of Transportation.

McCuskey, 78, is retiring midway through his five-year term. His recent report concluded that Benton engaged in a recurring pattern of sexual harassment against a lobbyist and two other women. Benton resigned from his position on July 3. Allegations have also been raised against McCuskey regarding his investigation, including accusations of mischaracterizing accounts and making inappropriate comments.

These issues have highlighted broader concerns regarding sexual harassment at the Illinois State Capitol. A recent investigation uncovered that House Speaker Emanuel ‘Chris’ Welch learned of a harassment complaint against Benton three years prior but took no action.

Previously, Risley worked under Carol Pope, who resigned in 2021, citing concerns over the office’s lack of authority. Despite these challenges, Risley is seen as suitable for the role, having been a favored candidate among legislative Democrats during McCuskey’s selection in 2022.

The Legislative Ethics Commission, composed of bipartisan lawmakers, appoints the acting inspector general until a permanent replacement receives confirmation. Risley will have full authority in the role and may serve until June 30, 2028, if necessary.

Upon Risley’s initiation on October 1, each legislative leader will appoint a representative to a search committee. This committee will review candidates’ resumes for the permanent position before forwarding recommendations to the full legislature.
