Peter Ticktin’s Advocacy for Declaring a National Emergency Over Election Security

Peter Ticktin, a Florida attorney and longtime friend of former President Donald Trump, has become a vocal advocate for declaring a national emergency over election security concerns. Ticktin’s connection to Trump spans decades, dating back to their time at the New York Military Academy, and he often refers to Trump as his childhood ‘best friend.’

Legal Career and Controversies

Throughout his legal career, Ticktin has taken on high-profile clients, such as a member of the Backstreet Boys and Samantha Markle, Meghan Markle’s half-sister. His involvement in conservative legal and political circles is notable. He was part of Trump’s legal team in a lawsuit against Hillary Clinton, accusing her of attempting to rig the 2016 election.

Ticktin represented Tina Peters, a former Colorado county clerk convicted of a voting system security breach. He claims her prosecution was politically motivated, although prosecutors deny this. Ticktin secured a symbolic pardon for Peters, granted by Trump. He also defended several January 6 rioters and criticized Attorney General Todd Blanche over their treatment.

Ticktin now claims foreign interference in the 2020 election, despite investigations and U.S. intelligence agencies finding no evidence of widespread fraud or interference altering the results. Newsweek reported his suspension from practicing law in 2009 for professional misconduct as determined by the Florida Bar Association.

Relationship with Donald Trump

Ticktin and Trump met in the 1950s at the New York Military Academy. Ticktin has often spoken about their friendship, calling Trump a close childhood friend. In 2020, he published the book ‘What Makes Trump Tick: My Years with Donald Trump from New York Military Academy to the Present.’

Although Ticktin advertised himself within conservative media as a potential successor to former Attorney General Pam Bondi, he has held no official role in Trump’s administration. His influence comes from his friendship rather than any formal governmental position. A White House official mentioned to CNN that Ticktin sometimes overstated his relationship with Trump.

Reason Behind His Call for a National Emergency

Ticktin argues that evidence will eventually support claims of foreign interference in the 2020 elections, suggesting Venezuela, China, and Iran were involved. He believes evidence will surface following the Trump administration’s actions against Venezuelan leader Nicolás Maduro.

His advocacy aligns with Trump’s frustration over Congress’s failure to pass the SAVE America Act, aimed at enforcing stricter voter ID requirements. Ticktin and others urge Trump to issue an executive order for a national emergency about foreign interference in electronic voting machines before midterm elections.

Ticktin promoted a legal memorandum focusing on the effects of a national emergency declaration, proposing it would grant greater federal oversight of election management. Collaborating with conservative activist Jerome Corsi, Ticktin worked on election security proposals, including a draft executive order.

Ticktin expresses concern about the upcoming midterm elections, alleging that Democrats plan to secure enough congressional seats to impeach Trump and Vice President JD Vance, clearing the way for House Democratic Leader Hakeem Jeffries to assume the presidency as Speaker of the House.

Legal Experts’ Opinions

Legal experts refute Ticktin’s arguments, underscoring the U.S. Constitution’s assignment of primary election administration responsibility to states and Congress. They argue that a president lacks authority to use emergency powers to assert control over federal elections in Ticktin’s proposed manner. The administration has not officially adopted Ticktin’s recommendations.

Whether Ticktin’s ideas will impact future White House policy is uncertain. However, his theories will likely continue to draw attention as debates about election security persist, leading into the 2026 midterm elections.
