Homeland Security Clarifies Policy on Green Card Applicants

The Department of Homeland Security (DHS) recently provided clarification on a controversial announcement made last week concerning green card applicants. Initially, immigrants applying for permanent residency were told they must return to their home countries while awaiting their green cards. However, DHS now emphasizes there is no significant change in policy and only certain individuals might need to leave the country.

This clarification appears to be a partial reassessment of the earlier announcement. Traditionally, U.S. policy has allowed immigrants to remain in the country during the processing of their green card applications. The initial announcement indicated a shift towards requiring individuals to return home during this process unless their cases were deemed ‘extraordinary.’

On Friday, DHS stated that this was not a blanket policy change. Instead, the decision will rest with individual immigration officers, who have always had the discretion to decide if an applicant must leave the country temporarily. ‘This was just a reminder to officers of their discretionary authority, which has always existed on a case-by-case basis,’ a DHS spokesperson explained, opting to remain anonymous.

The spokesperson noted that people who have overstayed their visas or come from countries with high usage of public assistance might be among those affected. While this clarification represents a shift from last week’s directive, it may not alleviate public confusion or concern as details about the criteria remain unclear. Even some DHS staff expressed uncertainty about the policy’s scope when first announced.

A senior White House official commented, under the condition of anonymity, that the announcement was intended as a routine procedure rather than a strategic policy change. The initial announcement was part of a news release, but the intent was misunderstood by many.
