France’s Constitutional Council has rejected a legislative proposal to prohibit social media access for children under 15, in a move seen as a setback for President Emmanuel Macron’s initiative. The Council determined that Article 1 of the law would restrict freedom of expression and communication among minors, deeming it inappropriate, unnecessary, and disproportionate.
The proposed law, set to take effect on September 1, aimed to prevent younger individuals from engaging with platforms like TikTok, Snapchat, and Instagram. It also included provisions for an age-verification system, which raised privacy concerns among the Council.
The French government argued that the ban would protect youth from social media’s adverse effects, such as anxiety, depression, sleep disorders, and cyberbullying.
Despite the Council’s decision, Macron remains committed to implementing a reform. The Elysee Palace announced that Prime Minister Sebastien Lecornu would draft a new version of the legislation, considering both the ruling and the European regulatory framework. Lecornu’s task is urgent, reflecting Macron’s unwavering resolve to address online safety for children.
Macron’s focus on internet child safety is a significant part of his presidential agenda, especially as his tenure nears its end next year. Under France’s two-term limit, he cannot pursue re-election in April 2027. This reform could be one of his last major domestic efforts.
Former Prime Minister Gabriel Attal expressed disappointment over the Council’s decision, acknowledging it on social media and describing social media as harmful to children.
Notably, the Council has yet to address another measure that would ban mobile phone use in high schools beginning September 1. French elementary and middle schools already impose restrictions on smartphone usage.
The global trend is moving towards regulating social media use among youths, with heightened awareness about potential negative impacts.
