Comey Criticizes DOJ’s Latest Legal Action as ‘Appalling Abuse’

James Comey has declared his innocence regarding allegations of communicating national defense information. He described the Justice Department’s actions as an ‘appalling abuse.’ The DOJ has filed criminal charges accusing him of disclosing sensitive information in 2016.

The Justice Department has initiated legal action against the former FBI Director by filing criminal charges in the U.S. District Court for the District of Columbia. These charges involve allegations of communicating classified information and conspiring to disclose it unlawfully. The DOJ stated that the filing aimed to preserve the charges before the statute of limitations expired as investigations continue.

Filing a criminal information to toll the statute of limitations is a widely recognized practice in federal court and has been approved by multiple Circuit Courts of Appeals.

Comey’s lawyers have contested the Department’s action, arguing that an indictment from a grand jury is needed before proceeding. U.S. District Judge Trevor McFadden held an emergency hearing where Comey’s attorneys aimed to dismiss the case and make the proceedings public. While the case was unsealed, the judge has not yet ruled on the dismissal request.

Prosecutors assert that on October 5, 2016, Comey shared national defense information with an unauthorized person. In response, Comey used Instagram to express his innocence and readiness to fight these accusations in court. He emphasized his belief in the federal judiciary’s independence.

This case is the third instance where the Justice Department has attempted to prosecute Comey under President Trump’s administration. A previous charge of lying to Congress was dropped, and another ongoing case relates to his ’86 47′ seashell social media post.
