Challenges to Educational Access for Undocumented Children

Some states are attempting to contest a long-standing precedent that allows undocumented children to attend public schools without charge.

In 1982, the U.S. Supreme Court confirmed the right of immigrant students in Texas to receive free public education, irrespective of their citizenship, with the decision in Plyler v. Doe. This ruling overturned a 1975 Texas law that permitted public schools to either impose tuition fees on these students or deny them access altogether.

All public schools across the United States are required to provide education to all students, regardless of their immigration status. This mandate seeks to ensure equal educational opportunities for children, fostering an inclusive environment where demographics do not hinder access to learning resources.
