A federal judge in Miami has reopened a $10 billion lawsuit by President Trump against the IRS. This decision marks a significant shift, as Judge Kathleen M. Williams aims to investigate claims that the quick settlement of the case was based on deception. Both President Trump, who had dismissed the lawsuit the previous week, and the Justice Department face a setback with this ruling.

After President Trump withdrew the lawsuit, the Justice Department disclosed agreements that established a $1.8 billion fund. This fund was intended to compensate individuals alleging government ‘weaponization’ by Democrats. Additionally, the deal provided tax advantages to Trump, his family, and businesses.

The development follows court papers filed by 35 former federal judges. They urged Judge Williams to revisit the case and examine the settlement details closely. Judge Williams, appointed during President Obama’s tenure, had previously questioned if the lawsuit presented an actual conflict, given Trump’s dual role as plaintiff and controller of the government agency involved.

In her recent order, Judge Williams expressed a desire to investigate Trump’s settlement efforts, suggesting possible misconduct. She ordered Trump’s lawyers to report by June 12 on whether the case should be officially reopened. The concerns include potential fraud against the court and Trump’s collaboration with the government to avoid judicial review.

Reports indicate that the IRS had a 25-page memorandum detailing defenses against the lawsuit that were not pursued by the Justice Department. The group of former judges expressed approval of Judge Williams’s actions. Norman Eisen, representing the judges, stated appreciation for the seriousness with which the allegations are being addressed.
