A surrogate mother declined an abortion request after the unborn child was diagnosed with a severe heart defect. She is now continuing her legal battle after the newborn underwent vital heart surgery. The surgery took place days after the infant was separated from her less than a minute post-birth.
Surrogate’s Experience and Legal Struggle
McKenna West, an Alaska resident and cardiac nurse, had carried the baby. On August 12, after giving birth, West expressed her continued commitment to the child, writing in an op-ed about her brief encounter with the baby. ‘I wasn’t allowed to hold the baby boy I carried and protected during my pregnancy,’ West shared. The only time she saw him was during the brief moments before the umbilical cord was severed.
Background and Legal Dispute
West had agreed to be a surrogate for Omar Ahmed and Nausheen Gilkar from California. When the baby was diagnosed with hypoplastic left heart syndrome (HLHS) at around 20 weeks, Ahmed and Gilkar reportedly requested an abortion, which West refused. West then relocated to Texas for the birth.
Lee Budner, representing the intended parents, contested parts of West’s account. He asserted that as soon as doctors deemed the baby fit for surgery, the parents consented. The child, named Rumi by Ahmed and Gilkar, underwent the Norwood surgery on August 17, a procedure often used for HLHS.
Legal and Medical Developments
Budner stated that Rumi’s medical condition remains critical. Meanwhile, West is accused of pursuing custody against court orders.
West, assisted by Alliance Defending Freedom, clarified her intentions. ‘I am not trying to take someone else’s baby,’ West noted. ‘I am fighting to ensure he receives the treatment his fragile heart needs.’
Lila Rose from Live Action supported West, emphasizing the need for someone to advocate for the child’s well-being. Rose questioned the actions of Ahmed and Gilkar, suggesting that legal intervention was required to ensure the surgery.
Ongoing Legal Dispute
The Texas Attorney General’s intervention underscored the child’s immediate medical needs after birth. The Norwood procedure is a vital step in a series of surgeries for HLHS, leaving Rumi’s future medical care in focus.
Budner mentioned the family’s choice to withhold further health updates due to the child’s complex condition.
West remains determined in her commitment to the child’s care, stating, ‘Let’s commit to ensuring this baby receives the full treatment he needs to live.’
