South Korea’s Former President Yoon Suk Yeol Sentenced for Drone Flight and Martial Law Cases

In a significant legal development, South Korea’s ousted President, Yoon Suk Yeol, was sentenced to 30 years in prison along with his former defense minister, Kim Yong Hyun. The charges centered around accusations that Yoon had ordered drone flights over Pyongyang in 2024, aimed at escalating tensions with North Korea and justifying martial law domestically.

Court’s Decision

The Seoul Central District Court found both Yoon and Kim guilty of aiding an adversary and abusing their power. The court indicated their actions were intended to provoke North Korea into hostile reactions, potentially leading to a contrived national crisis.

Consequences and Previous Sentencing

The court stated that Yoon’s actions harmed South Korea’s military capabilities and prompted North Korea to bolster its defenses. Earlier, the court sentenced Yoon to life imprisonment for imposing martial law in December 2024, which lasted only a few hours before being overturned by the National Assembly.

North Korea’s Accusations

North Korea accused the South of dropping propaganda leaflets via drones in October 2024. Kim Yong Hyun, then the defense minister, initially issued a vague denial and the Defense Ministry neither confirmed nor denied these allegations. Despite heightened tensions, no military conflict ensued.

Defense and Prosecutor’s Arguments

Yoon’s legal team argued that the drone flights were retaliatory acts following North Korea’s balloon provocations earlier in 2024. They also suggested that the conviction might threaten South Korea’s security but did not immediately confirm an appeal.

Special prosecutor Cho Eun-suk led the investigation, seeking a 30-year sentence for Yoon and a 25-year sentence for Kim. They accused Yoon of attempting to provoke a wartime atmosphere to consolidate power and eliminate political adversaries.

Martial Law and Political Fallout

Yoon declared martial law on December 3, 2024, accusing opposition lawmakers of being sympathetic to North Korea and citing various grievances including budget cuts. Martial law was lifted after a brief duration when lawmakers voted against it, ending the imposition.

Following his suspension and impeachment, Yoon was formally removed from office and arrested in July 2025. The most serious charge against him, rebellion, is under appeal, with both Yoon and prosecutors challenging the verdict.
