South Carolina Supreme Court Orders Retrial for Alex Murdaugh in Murder Case

The South Carolina Supreme Court has directed a retrial for Alex Murdaugh, sending his murder case back to a lower court. This marks the beginning of a potentially long legal process in the region.

An entry dated May 29 recorded this decision as a ‘Remittitur’ concerning Richard Alexander Murdaugh. Now, the case returns to the trial level, where lawyers and the court will orchestrate the new murder proceeding. This will involve scheduling hearings, revisiting pretrial motions, dealing with evidence disputes, and arranging a possible new trial date.

In May, the state Supreme Court called for a retrial, overturning one of South Carolina’s most notable convictions. Murdaugh, once a powerful legal figure in the Lowcountry, was found guilty in 2021 of killing his wife and younger son at their Colleton County property.

South Carolina Attorney General Alan Wilson stated his goal to expedite the retrial: “We would like to bring this case back before January 2027,” he remarked, while admitting the timeline could change.

Murdaugh’s lead defense attorney, Dick Harpootlian, disclosed plans to request a venue change, attorney-led jury questioning, and possibly sequestering jurors. The defense intends to examine potential jurors’ online activities before they appear in court.

The retrial follows the state’s Supreme Court decision to reverse Murdaugh’s convictions. The ruling cited improper actions by Colleton County Clerk of Court Rebecca ‘Becky’ Hill, who influenced jurors during the previous trial.

Despite the overturned murder convictions, Murdaugh remains incarcerated for financial crimes.
