An attorney representing Illinois residents involved in legal action against the federal government over a major immigration enforcement operation in Chicago has expressed confidence that U.S. Immigration and Customs Enforcement (ICE) agents will face accountability soon. Antonio Romanucci of Romanucci & Blandin highlighted during a conversation with Newsweek that substantial video and photographic evidence exists, suggesting excessive force by federal agents.
The Federal Tort Claims Act (FTCA) offers a legal avenue for pursuing federal agents depending on the agency’s response. Romanucci announced that 15 FTCA filings were made by American citizens and a green card holder regarding Operation Midway Blitz. These filings could lead to accountability from certain government individuals and agencies.
Details of Operation Midway Blitz
Operation Midway Blitz was a significant immigration enforcement action that occurred in Illinois during the second Trump administration. It involved federal agents targeting Chicago and its surroundings, leading to protests, confrontations, and legal challenges. According to the Department of Homeland Security (DHS), over 4,500 immigrants were detained during the operation.
Critics claimed federal agents used excessive force, including against U.S. citizens who were protesting and recording the events. Former DHS Secretary Kristi Noem defended the agents’ actions. Romanucci contended that the force used was excessive and demonstrated through video evidence and client testimonies.
Claimants and Their Allegations
The legal action involves claims from journalists, U.S. citizens, and other individuals. Among them are Juan Munoz, an Oak Park elected official, and journalist Leigh Kunkel. They, along with others like attorney Jennifer Moriarty, allege unlawful detention and rights violations.
“Constitutional rights do not depend on your name, skin color, citizenship, political beliefs, or whether anyone is watching,” Muñoz emphasized.
Another claimant, Kyle Frankovich, demanded accountability at all levels, alleging harm to families and individuals, including permanent disabilities and fatalities.

Romanucci emphasized the importance of recorded evidence in supporting future litigation. He noted that the video footage captured constitutional violations and that his team collected extensive evidence from eyewitnesses and the scene.
Government Responses
Throughout Operation Midway Blitz, DHS maintained that federal operations were legal and necessary. They noted an increase in assaults on federal officers and stated they would prosecute individuals obstructing or assaulting agents.
In response to multiple controversies, including fatal incidents in Minneapolis, DHS has reduced the scale of its operations.
Future Steps Under FTCA
The FTCA process requires claimants to file administrative claims with the government. If unresolved after six months, the claims can escalate to federal court. Romanucci indicated that the legal team aims to challenge the administration and agencies responsible for the alleged unconstitutional actions.
