A retired Massachusetts Superior Court judge shared insights into the complexities of a not guilty verdict by reason of insanity in Lindsay Clancy’s case. Judge Jack Lu emphasized that such a verdict would not grant Clancy an easy escape from confinement. The ultimate decision regarding her release would lie with prosecution-aligned medical professionals.
Clancy, aged 36, is facing three counts of first-degree murder for the deaths of her children—Cora, Dawson, and Callan—all under the age of six. They were tragically found strangled at their home in January 2023.
If Clancy is found not guilty by reason of insanity, she will likely spend extended time in a mental institution. Judge Lu explained that mental health experts would periodically review Clancy’s commitment but noted their tendency to side with the prosecution, often favoring prolonged institutionalization.
“They’re viewed as an arm of the prosecution,” Lu explained. These officials often consider confinement as the safest option.
Judge Lu noted that escaping a mental institution isn’t simple. Clancy could be held for many years unless a court intervenes due to reevaluations of her mental state.
Another potential route for Clancy’s release involves court hearings. If the government continues her commitment, and if medical experts fail to approve her discharge, a judge might assess her threat level through contested hearings. Winning these hearings could lead to her release if she’s deemed not a danger to herself or others.
Clancy’s trial draws comparisons to the infamous case of Constance Fisher. Fisher drowned her three children in 1954 and was committed to a mental hospital. Years later, she repeated the crime and was sent back to the institution, ending in her death.
The jury deliberating on Clancy’s case consists of nine women and three men, with a female foreperson. After three days without reaching a verdict, they adjourned for the day and plan to resume deliberations.
