Oklahoma Secretary of State Faces Arrest Over Intoxication Incident

Newly released police bodycam footage shows Oklahoma Secretary of State Benjamin Lepak being arrested on suspicion of public intoxication outside a McDonald’s.

On a Friday night in Edmond, around 10:45 p.m., police received a report of a man appearing drunk in public. Officers found Lepak near the drive-thru window, with his vehicle in the parking lot, which he confirmed belonged to him.

According to an arrest affidavit, an officer noted Lepak had “extremely slurred speech” and a noticeable “odor of an alcoholic beverage” on his breath. Lepak also struggled to retrieve his identification from his wallet.

The bodycam video shows officers questioning Lepak about his whereabouts, alcohol consumption, and how he got to the McDonald’s. Lepak mentioned he attended a church gathering with other fathers earlier in the evening. Despite denying he was unsteady on his feet, police reported Lepak could not maintain a coherent train of thought during the encounter. He acknowledged drinking beer and claimed he’d had less than one beer as he did not finish it.

Officers arrested Lepak on suspicion of public intoxication, alleging he gave contradictory statements about his transportation to the McDonald’s. Lepak’s spokesperson told Fox News Digital that Lepak awaited dinner outside McDonald’s and was not given a breathalyzer test. The spokesperson mentioned Lepak would address the ticket appropriately through the legal process.

The arrest prompted Attorney General Gentner Drummond to urge Republican Gov. Kevin Stitt to dismiss Lepak. Drummond criticized Stitt for appointing Lepak, recalling a previous arrest for Lepak when found unconscious in a running vehicle.

Stitt appointed Lepak as Oklahoma Secretary of State in October 2025. Lepak had served as the governor’s general counsel and executive director of the State Chamber Research Foundation.
