Paul raised the issue on “The Will Cain Show,” asking, “The legal question is, if you’re pardoned, can you really claim the Fifth?”
The Fifth Amendment is a safeguard against self-incrimination, usually invoked to prevent individuals from testifying against themselves in legal proceedings. Paul argued, “If you’ve already been given immunity, you can’t self-incriminate unless you lie.” The senator questioned the appropriateness of Fauci’s repeated use of the Fifth Amendment after receiving immunity through the pardon.
Paul, who chairs the Senate Homeland Security and Governmental Affairs Committee, is pursuing a vote to hold Fauci in contempt of Congress. Fauci declined to address questions on his response to the COVID-19 pandemic and his involvement with controversial gain-of-function research.

Paul has recently made public over 1,000 pages of Fauci’s diaries from 2019 to 2022. These diaries reveal Fauci’s preoccupation with his newfound fame during the pandemic and his reflection on public discussions about the virus’s origins. The diaries reflected contrasting narratives between Fauci’s private discussions and his public affirmations about COVID-19’s origin being a natural occurrence.

Paul aims to challenge the legal foundation of Fauci’s pardon, proposing that a pardon negates the need for the Fifth Amendment. “There are some really important legal questions here,” Paul stated, indicating his plan to argue the point further in court.
Expressing frustration, Paul shared his disappointment over the hearing. He also criticized his Democratic colleagues for bypassing critical discussion on government responsibility in the pandemic, which claimed over a million American lives. “They don’t seem to care about the truth,” Paul remarked, questioning their priorities.
