Videos circulating on social media have shed light on the shooting of 28-year-old Venezuelan, Wilber Rafael Garces Perez, by an ICE officer in Austin. The incident took place shortly before 1 p.m. near Anderson Square and Research Boulevard on the city’s north side. Garces Perez, identified by attorney Kate Lincoln-Goldfinch, was delivering for DoorDash when the shooting occurred.
DoorDash confirmed to Newsweek he was on a delivery. The company is investigating but shared no additional details. DoorDash stated that Dashers are independent contractors.
It’s uncertain if Garces Perez was targeted in an immigration operation. He lawfully entered the country seeking asylum, as per Lincoln-Goldfinch. However, a Homeland Security spokesperson described him as an “illegal alien” with a removal order.
Police and Media Reports on the Incident
Austin Police Chief Lisa Davis stated that Austin officers were not part of the shooting. She mentioned hearing about a “small foot pursuit” but lacked complete details.
Bystander videos provide some clarity. An Austin resident, Heidi Ann Clark, streamed the scene, capturing an unmarked SUV stopping near Garces Perez’s blue Toyota Corolla. An ICE agent approached with a firearm, and shots followed. Another video shows the area after police secured it, while bystanders questioned the lack of immediate medical aid.
In these videos, witnesses express anger, demanding answers and assistance for Garces Perez. After the shooting, police examined the wound and provided some medical help, while bystanders continued their outcry.
Community’s Reaction to the Shooting
Lincoln-Goldfinch issued an update stating Garces Perez’s wife was initially denied access to him at Dell Seton Medical Center. They learned about his stable condition through Austin Mayor Kirk Watson’s visit. It’s likely he was later moved to a federal detention center.
The incident has outraged Austin officials, reminiscent of a prior ICE shooting in Houston. Mayor Watson criticized ICE, calling their actions “rogue” and urged Austin police involvement for transparency.
U.S. Representative Greg Casar implored on social media against Garces Perez’s deportation, emphasizing the need to retain him as a witness and ensure proper medical care.
A DHS statement to Newsweek reiterated that Garces Perez, labeled an “illegal alien,” remained in federal custody post-shooting with a stable condition, waiting removal. The investigation is led by Homeland Security Investigations with the FBI’s assistance.
