A motion filed by 35 former federal judges seeks to reopen a closed case involving former President Trump and the Internal Revenue Service (IRS). The judges have asked the overseeing judge to reconsider the settlement terms in a case dismissed in January.
Background of the Lawsuit
In January, Trump, alongside two of his sons and the Trump family business, sued the IRS. The suit claimed they were owed at least $10 billion. However, the case was swiftly dismissed after Trump voluntarily withdrew the suit. The dismissal followed an agreement which provided two significant benefits.
Contents of the Settlement Agreement
- A $1.8 billion fund to compensate Trump allies who claimed they suffered federal government “weaponization.”
- Lucrative tax benefits for Trump, his family, and his businesses.
The settlement has raised concerns over transparency and fairness in the legal system. The former judges, represented by Democracy Defenders and two law firms, believe the deal could be considered fraudulent.
Legal Challenge to the Settlement
The judges filed their motion in the Federal District Court in Miami, urging Judge Kathleen M. Williams to examine whether the settlement terms were reached to avoid legal scrutiny. The motion suggests potential manipulation of the judicial process.
The purported ‘settlement’ that was publicly disclosed after this court dismissed this matter raises profound questions about the parties’ candor toward the court and manipulation of the judicial system, which threatens to undermine confidence in the administration of justice, lawyers for the former judges wrote.
In response, the Justice Department called the motion “frivolous,” stating that dismissing cases without referencing settlements is routine.
