In Plymouth, Massachusetts, Lindsay Clancy’s legal team and state prosecutors have reached an agreement to defer the motion by defense attorney Kevin Reddington. The motion aims to investigate the sole holdout juror in Clancy’s recent mistrial. Attorney Edward Paltzik shared this update with Fox News’ Kayleigh McEnany.
The final ruling hinges on Judge William Sullivan’s decision, who has yet to make an announcement. The postponement is due to the juror’s lawyer stating that he lacks access to sealed information critical for responding. “The DA and Reddington consent to adjourn the motion to investigate Michael,” Paltzik remarked. “If Judge Sullivan issues an order today, much could be postponed. Regardless, a status conference is likely. Yet, the motion concerning Michael might not occur tomorrow.”
Michael P. Desronvil, the single dissenting juror, was pivotal in Clancy’s mistrial. Clancy faced charges connected to the strangling deaths of her three children. Clancy will appear in court at 9 a.m. Tuesday for a status update post-mistrial, marking her first court session since jurors reached a deadlock on September 4. “Our local counsel will attend either way,” Paltzik confirmed. “All actions are subject to the Judge’s discretion.”
The hearing was anticipated to address Reddington’s motion for an inquiry into Desronvil, alongside a motion contesting the charges under double jeopardy, favoring dismissal over a retrial.
Prosecutors are also set to provide updates on their future actions. Reddington requested a court inquiry into Desronvil, the only juror among 12 who insisted on Clancy’s guilt in the murders of her children, Cora, Dawson, and Callan.
The other jurors concurred on a not guilty verdict due to mental illness, following Reddington’s argument that Clancy suffered from postpartum psychosis.
Paltzik raised questions regarding Reddington’s non-objection to Desronvil during jury selection. With a total of 12 jurors and four alternates, Reddington had 16 potential strikes available before the trial commenced.
