Justice Department Withdraws Subpoenas for Washington Post Reporters

The Justice Department initially sought to compel Washington Post reporters to testify before a federal grand jury but reversed the decision after legal challenges. According to a Washington Post story, Justice Department sources confirmed subpoenas were issued to reporter Ellen Nakashima this spring regarding national security reporting.

The Washington Post contested Nakashima’s subpoena in federal court in Virginia. The government withdrew the subpoena in response to these legal proceedings. The scope of the investigations triggering the subpoenas remains unclear, aside from their connection to national security.

In response, a Washington Post spokesperson emphasized the constitutional violation of press freedom, stating the subpoena aimed to enlist journalists as investigative tools. The spokesperson declared unwavering support for the newspaper’s journalism and commitment to fighting government efforts infringing on First Amendment rights.

Ellen Nakashima is described as an experienced national security reporter who covered stories about intelligence officials, the Iran conflict, and U.S. military actions during the Trump administration.

Executive Editor Matt Murray addressed Washington Post employees, affirming strong support for First Amendment rights and journalists’ legal protections. He highlighted the commitment to investigate and report without government interference, appreciating the legal team’s efforts in defending the newspaper’s rights.

Additionally, subpoenas were issued to three Wall Street Journal reporters covering national security. The Justice Department withdrew these subpoenas too following legal challenges. No journalists testified in front of the grand jury according to anonymous sources discussing the closed proceedings.
