Tyler Robinson Faces Preliminary Hearing for Charlie Kirk Assassination

In Provo, Utah, Tyler Robinson appeared in court for a preliminary hearing regarding the assassination of Charlie Kirk. Prosecutors plan to present extensive evidence, including testimonies and text message confessions, linking Robinson to the crime. Retired FBI agent James Gagliano highlighted the Kirk family’s demand for transparency, with cameras allowed in the courtroom.

Robinson’s alleged poor shooting accuracy during practice with the suspected murder weapon has been emphasized by Utah prosecutors. This is being used to argue against the defense’s attempt to remove the death penalty option before trial. Prosecutors believe Robinson knowingly endangered others by targeting Kirk from a rooftop overlooking a large crowd. Kirk was fatally shot in the neck while addressing an audience.

The defense claims the gunshot originated above the crowd, striking only the intended target, Charlie Kirk, with no bystanders injured. They argue that the scenario implies no immediate threat to others, challenging the need for the death penalty.

Capital punishment would require prosecutors to demonstrate that the shooting posed a significant risk to others beyond Kirk. The defense hopes to eliminate this factor to avoid the potential death sentence if Robinson is convicted.

Judge Tony Graf Jr. plans to decide on September 1 whether there is sufficient cause for trial continuation. Throughout the hearings, images of shooting targets and the alleged weapon were displayed in the courtroom.

The hearing explored whether sufficient evidence exists to proceed to trial. Prosecutors criticized the defense’s approach, alleging they ignored essential legal precedents. They maintain any reasonable inferences must favor the state’s position.

Robinson, yet to enter a plea, allegedly drove from southern Utah to Orem, shooting Kirk during a Turning Point USA event at Utah Valley University in September 2025. Afterward, he reportedly confessed to multiple individuals before surrendering to authorities.
