Supreme Court to Review Historic Ban on Home Spirit Distilling

The Supreme Court has decided to examine the constitutionality of a longstanding federal prohibition on home spirit distilling, enacted back in 1868. This case brings into question a restriction that has been in place for nearly 160 years, originally introduced to prevent tax evasion.

Scott McNutt, a resident of Robbinsville, New Jersey, challenges this historic ban. McNutt previously utilized a still to produce fuel alcohol and now seeks the freedom to create spirits at home. He contends that the ban violates constitutional rights and stifles personal experimentation in spirit crafting.
