An immigrant mother who entered the U.S. illegally faces legal charges following a fatal car crash in Arizona. Brenda Rivera Estrada, 30, is accused of causing the death of her nine-year-old daughter in a rollover accident while intoxicated.

Details of the Incident

The crash occurred on April 12 on Interstate 17 near Cactus Road in Phoenix. Rivera Estrada’s SUV overturned, resulting in her daughter’s death. Three other children in the vehicle, aged 11, 3, and 1, incurred minor injuries. Maricopa County Attorney Rachel Mitchell disclosed that toxicology reports indicated the presence of methamphetamine and marijuana in Rivera Estrada’s system.

Charges and Legal Proceedings

Authorities indicted Rivera Estrada on charges of manslaughter and child abuse. Additionally, she faces counts of endangerment, possession of dangerous drugs, and possession of drug paraphernalia. Witnesses claimed she exceeded the 65 mph speed limit during the incident. A grand jury also brought forward a Class Two Dangerous Felony charge for manslaughter.

Following her indictment, Rivera Estrada returned to Maricopa County Jail from ICE custody, with her bail set at $250,000. Officials previously released her from local custody before she was detained by immigration authorities pending the investigation.

Rivera Estrada, a Mexican national, allegedly entered the U.S. through Nogales, Arizona, in February 2009, with a temporary stay permit of 30 days. She continued to reside in the U.S. beyond this period, violating federal immigration laws. The indictment was delayed as investigators awaited comprehensive insights from toxicology and crash reconstructions.

Mitchell expressed the importance of taking time to gather all necessary evidence for convicting Rivera Estrada beyond reasonable doubt. She emphasized that complex cases warrant thorough examination.

ICE officials highlighted the significance of their Criminal Alien Program in identifying and arresting Rivera Estrada. Alejandro Almeida, Deputy Field Office Director for Phoenix’s ICE Enforcement and Removal Operations, remarked on the public safety initiative’s role in this case.

Rivera Estrada remains in custody, awaiting further legal proceedings.
