Judge Oversees Unsealing of Warrant in Ilhan Omar Investigation

A legal battle is ongoing over whether to make public the warrant used to search Rep. Ilhan Omar’s home in a case overseen by a federal judge known for frequent rulings against former President Donald Trump. This conflict arises amidst two federal probes into Rep. Omar, focusing on discrepancies in her financial disclosures and allegations of immigration fraud involving her father.

The Investigations

Concerns have surfaced about disclosures filed a year apart along with claims that Omar’s father misrepresented her age in 2000 on immigration documents, potentially allowing her to gain citizenship as a minor. Rep. Omar came to the United States from Somalia in 1995 when she was 12 years old.

Trump, a longtime critic of Omar, has accused her of marrying her brother. In response to an October 12 raid on her Washington, D.C. home, Trump called for her to be jailed.

Judge Boasberg’s Role

Chief Judge James Boasberg, overseeing the matter, has faced criticism from Trump who labels him as biased and incapable of providing a fair decision. Trump’s remarks against Boasberg intensified after the judge blocked deportation flights for alleged Venezuelan gang members in 2025.

The controversy over unsealing the warrant intensified pre-midterm elections as alleged social services fraud in Minnesota turned political. Federal agents raided Omar’s home under a warrant issued by Magistrate Judge Matthew Sharbaugh.

Media Requests for Transparency

Multiple requests came in to unseal the warrant, including from The New York Times, Judicial Watch, and other press organizations. Boasberg initially instructed the Justice Department to justify the sealed warrant by an October deadline but later extended it to allow the warrant’s full execution per the department’s request.

The Justice Department maintains that revealing details prematurely could affect the investigation’s integrity. Meanwhile, media groups argue that non-sensitive details should be redacted, not the entire document withheld.

Ongoing Disputes

Separately, Omar’s legal team demands the return of seized items, alleging violations of her congressional protection. They claim agents did not provide her a warrant copy nor allowed her legal representation.

The handling of record preservation and phone record subpoenas in other high-profile cases has also subjected Boasberg to Trump allies’ criticisms. His decision for former FBI attorney Kevin Clinesmith sparked further dissent, with his sentencing highlighted as lenient by Trump’s camp.
