Cornell University Engages Sally Yates for Probe into Handling of Rape Allegations

Cornell University has enlisted Sally Yates, former acting U.S. attorney general, to lead an independent investigation into its handling of rape allegations from a former student. This move aims to address concerns related to the university’s response and policies surrounding sexual misconduct.

Yates, who holds a position at King & Spalding and previously served as U.S. deputy attorney general under President Obama, was appointed by the Special Committee of Cornell University’s Board of Trustees. Her investigation will focus on examining the university’s policies on preventing and responding to sexual harassment, sexual assault, and related campus misconduct.

The backdrop to this development involves a civil lawsuit filed by a former student, identified as Jane Doe, alleging she was drugged and gang raped in October 2024 at the Chi Phi fraternity house on campus. The university’s reaction to Doe’s complaint has sparked protests both on campus and nationwide. The individuals named in the lawsuit have denied any misconduct, and criminal charges have not been pursued against them.

A statement by Anne Meinig Smalling, chair of the special committee, emphasized Yates’ qualifications and experience, highlighting the need for a thorough examination. She stated that Yates and her team are tasked with assessing Cornell’s current practices in preventing and responding to sexual misconduct, identifying strengths and areas for improvement, and recommending changes to enhance campus safety.

While the university insists that its police force conducted a thorough investigation and a Title IX inquiry resulted in suspensions and expulsions, student protests have increased following Doe’s legal action. Additionally, New York Governor Kathy Hochul has appointed state Attorney General Letitia James to conduct a criminal investigation, responding to criticism of the handling by campus police and local prosecutors.

The case has reignited discussions at the national level regarding consent and sexual assault on college campuses, highlighting the importance of addressing these issues decisively and transparently.
