Conservative activist Robby Starbuck achieved a significant legal advancement against Google with a Delaware Superior Court allowing his defamation lawsuit to proceed. Last October, Starbuck filed for at least $15 million, accusing Google’s artificial intelligence (AI) programs of defaming him through false portrayals as a ‘monster’ in what he describes as ‘AI hallucinations.’ Judge Meghan Adams noted the allegations could support a claim for emotional distress at this stage, permitting the case to move to discovery.
‘The Court views these allegations as sufficient to support a claim for emotional distress damages at this stage in the proceedings, being sufficiently well-pled to proceed to discovery and flesh out the allegations,’ Judge Meghan Adams ruled in the court filing.
Starbuck took to social media to express his thoughts on this development, questioning whether political bias or other factors led to AI’s portrayal of him. He emphasized the importance of the discovery phase in uncovering how Google’s systems might have spread these claims.
Starbuck further stated, ‘Sunlight is the best disinfectant, and it’s about to get bright in here. Discovery means we get to find out what Google knew, who knew it and why they allowed their AI products to continue spreading these horrific lies.’ He also described Google’s failed attempt to halt the proceedings as a ‘David versus Goliath’ moment, driven by the pursuit of justice.
In a statement, he reflected on the broader implications of AI’s role in society, stressing the need for systems that do not cause harm to individuals. The case aims to establish a precedent to protect against AI-induced defamation and potential future harm.
‘As we enter a time when AI increasingly dominates everything around us, we must ensure that it can’t hurt people. What was done to me should never happen to anyone else,’ Starbuck said.
Google has not yet commented on the lawsuit. Starbuck’s legal complaint claims Google’s AI platforms have been disseminating false allegations against him since 2023, despite his cease-and-desist orders. Specific false claims included accusations of sexual assault and harassment, alleged to have reached millions of users. A critical moment was the false accusation of child rape, leading Starbuck to pursue the lawsuit more vigorously.
