Supreme Court Decision on Challenge: Understanding the Standing Grounds

Liberal Justice Elena Kagan, speaking at a conference this summer, addressed the perception of the court’s conservative majority.

Justice Kagan acknowledged the court’s conservative leanings. She said, “Is this court very conservative? Does it do a bunch of things that are out of the playbook of the conservative legal movement that I think are deeply wrong? You know, yes.” Despite her critique, Kagan argued against the notion that the court acts as a proxy for the current administration. “But is this court the kind of puppet for the current administration? I think definitely not,” she added.
