The video captures an agent employing a racial slur to describe a man seen during the operation. Using a derogatory term, the agent commented on the individual’s appearance. These terms have previously been criticized and are reportedly banned among Border Patrol agents.
Such footage was obtained by the ACLU after allegations that ICE and Border Patrol officers engaged in racial profiling under President Trump’s mass deportation initiative. Lawyers assert that agents are targeting individuals based on their appearance and perceived ethnicity, specifically Latino and working-class individuals.
The Supreme Court sided preliminarily with Trump, though civil rights attorneys persist in gathering supporting evidence to challenge this decision. Notably, Justice Brett Kavanaugh noted that agents can consider ‘apparent ethnicity’ in developing suspicion, yet specified that arrests must not solely rely on race or ethnicity.
Efforts continue to gather evidence. Federal Judge Maame Ewusi-Mensah Frimpong demanded access to related video and text messages to determine if racial profiling is occurring. DHS maintains its operations are targeted and that agents perform due diligence.
