President Trump announced on Thursday that he might withdraw the nomination of Todd Blanche for Attorney General. This decision stems from ongoing disputes with Senate Republicans over a controversial tax audit immunity settlement favoring Trump and his family.
The nomination process hit a roadblock when negotiations stalled, preventing a committee vote. Trump indicated his intention to resist pressure from Republican Senators John Cornyn and Thom Tillis. These senators raised concerns about a settlement between Trump and the IRS, which a judge criticized as self-serving.
The Justice Department remained open to striking a deal with the senators. However, the White House refused to compromise to support Blanche, Trump’s loyal former personal attorney. Blanche has faithfully advanced the administration’s priorities as acting attorney general.
Trump hinted he might withdraw Blanche’s nomination, intending to resubmit it once senators Cornyn and Tillis leave office next year. In a social media post, Cornyn remarked that the president is mistaken if he believes the settlement issues are restricted to him and Tillis.
Following Trump’s comments, Blanche met with Cornyn and Tillis to resume collaborative efforts towards his confirmation. The senators demand written commitments regarding the settlement, especially concerning the controversial immunity from tax audits for Trump and his family. While the fund was canceled amid bipartisan criticism, the immunity provision is still a point of contention.
Opposition from Democrats and a single Republican dissent could jeopardize Blanche’s nomination. Even if approved by the Senate Judiciary Committee, Blanche needs Republican support for full confirmation. Tillis emphasized his concerns, suggesting the immunity provision could be restricted to existing audits and omit future filing protections.
Despite Republican opposition to the settlement, Cornyn remains the main adversary to Blanche’s nomination. Cornyn lost his seat due to Trump’s opposition in a GOP primary, while Tillis, not seeking re-election, has criticized the administration on related issues.
Withdrawing Blanche’s nomination could cause embarrassment for the Trump administration but may not impact the Justice Department’s operations significantly. Blanche may still serve as acting attorney general or deputy attorney general. This position can manage the Department if the attorney general role remains vacant.
