A Los Angeles judge has ruled that there is enough evidence to try the singer D4vd, real name David Burke, for the murder and dismemberment of 14-year-old Celeste Rivas Hernandez. Authorities claim she threatened to reveal their relationship, risking his career.
Preliminary Hearing Findings
Judge Charlaine Olmedo determined that the evidence presented in the five-day preliminary hearing provides probable cause for trial on charges of murder, ongoing sexual abuse of a minor, and illegal mutilation of human remains. Olmedo stated, “The prosecution has met its burden on all charges.” Burke remains in custody without bail.
Although the burden of proof in a preliminary hearing is lower than at trial, prosecutors argued the evidence was compelling. Deputy District Attorney Beth Silverman said, “With the overwhelming evidence presented, all charges are clearly established.”
Defense Arguments
The defense claimed the evidence of murder was insufficient and moved to dismiss the charge. Burke’s attorney, Marilyn Bednarski, argued that there was no evidence Burke intended to kill Hernandez, highlighting the lack of threats or violent history between them. The defense criticized the coroner’s finding of homicide as vague.
The defense also argued that Hernandez exhibited threatening behavior in her messages and that any malicious intent came from her. Prosecutors countered that attempts to discredit the victim, a minor, were unfounded.
Evidence of Murder and Cover-Up
Prosecutors presented a timeline detailing the night of Hernandez’s death, showing her phone went silent after meeting Burke. Surveillance showed Burke was the last person to drive the Tesla where Hernandez’s body was found months later.
Analysts tied blood evidence in Burke’s garage to Hernandez. Prosecutors alleged Burke killed Hernandez, dismembered her in the garage, and transported her remains in his vehicle. They say he sent deceptive messages after her death feigning concern.
Documented Abuse
Testimony included explicit photos and messages detailing a history of abuse, alleging Burke impregnated Hernandez at 13, resulting in an abortion.
Burke’s Rising Career
Before these allegations, Burke’s career was on the rise with popular tracks and performances. His music gained millions of plays across platforms, and he performed at Coachella in 2024, around the time of Hernandez’s death.
