Missed Opportunities in LGBTQ Advocacy

Advocates failed to build a genuine public consensus. This oversight affected cases like West Virginia v. B.P.J. and Little v. Hecox. These cases challenged laws in West Virginia and Idaho. The laws prevented transgender women and girls from participating in women’s school sports.

The Supreme Court reviewed both cases this term. The outcome seemed clear to many. Even LGBTQ activists acknowledged the difficulty in succeeding. This acknowledgement highlighted a lack of preparedness and support.
